Untangling Ogilvie – 9/13/2011
This controversial case has many scratching their heads wondering, “What do we do with Ogilvie?” Don Barthel, Esq. will focus on untangling Ogilvie so that it can be understood in simple terms to provide a better understanding of when it can be used, how to defend it and what the future holds in applying it. He will discuss the July 29th decision by the California’s First District Court of Appeal that annulled the award by the California Workers’ Compensation Appeals Board and sent the case back to the appeals board for further review. The Court upheld the WCAB’s position that the schedule used in setting permanent disability benefits is open to challenge. Chris Brigham, MD will reflect on the physician’s role in assessing permanent disability. You will learn that in some ways the Ogilvie decision makes things easier and in some ways it complicates matters.

Unraveling the Mysteries of Rating – 10/20/2011
Permanent disability ratings are a key cost driver in the workers’ compensation system. Issues surrounding permanent disability often become convoluted resulting in a less than optimal approach to managing the issue. This session will provide you with a medical and legal perspective on the severity of the problem with inaccurate impairment ratings and how to manage them in an effective way. Chris Brigham, MD will reflect on the physician’s role in using the AMA Guides to the Evaluation of Permanent Impairment and Don Barthel, Esq. will discuss legal approaches to achieve a correct rating.

Apportionment-Every Defendant’s Friend – 11/17/2011
Apportionment has long been a controversial topic in the California workers’ compensation system. This session will simplify the approach of how apportionment should be applied in your cases. Doctor Cross-Examination – 1/25/12
In that cross-examination of the evaluating physician is a common defense strategy we will provide you with insight on best practice approaches for ensuring you get the most out of your deposition. Tips will be given on preparing the case for the deposition, do’s and don’ts in cross-examination, and appropriate follow-up after the process. We will also provide a medical perspective so that you can learn how the deponent prepares for their cross-examination. Effective cross-examination will be demonstrated.
